General Terms & Conditions
Jamiat Alnakheel Tree Trading Palms

1. Company Liability After Delivery
The company holds no responsibility for the condition of the palm offshoots or trees after they have been received by the customer or their representative. Delivery of the order and issuance of the invoice are considered confirmation that the items have been received as described.
No claims or complaints will be accepted after delivery, except in cases where the type of palm variety is proven to be incorrect, and only if proof is submitted within 7 working days of delivery.
A formal agricultural report from an accredited authority must be attached to any complaint. The case will be reviewed by the company’s internal technical committee, whose decision is final and binding.

2. Classification and Variety Guarantee Policy
All offshoots are delivered based on their external classification as determined by the company’s experienced agricultural team.
The company is not liable for any differences in growth or outcome after planting, especially if such differences result from environmental conditions, planting methods, or customer negligence.
The company provides an exclusive guarantee on the palm variety only for up to six (6) years from the delivery date, provided that:
The tree is properly cared for.
A certified agricultural report confirms that the delivered variety does not match the agreed-upon type.

3. Reservation and Payment Policy
An order is only considered confirmed once full payment or a minimum 50% down payment has been received.
If payment is not completed within 5 days from the date of the invoice, the reservation will be automatically cancelled without notice.
The company reserves the right to cancel or modify any order without compensation in cases of agricultural, logistical, or external disruptions beyond its control.

4. Delivery and Preparation Timeline
Order processing begins once the customer has finalized approval and the required payment has been received.
Delivery and preparation typically take between 3 to 14 business days, depending on order size and availability of requested items.
The company does not offer direct delivery services. Orders can be delivered through:
Direct pickup by the customer or their authorized representative.
Coordination with a third-party delivery service selected and paid for by the customer.
The customer will be informed of all order details (types, quantities, sizes) via official communication channels, such as:
WhatsApp
Email
Instagram
The company is not responsible for any damages occurring during transportation by third-party providers.

5. Late Pickup Policy
Orders must be collected within 7 days of the notification of readiness.
If the customer fails to collect the order without prior coordination, storage fees may be applied, and the order may be cancelled after 14 days with no refund of any previously paid amounts.

6. Technical Support & Follow-Up
The company provides general care guidance upon request.
On-site visits or extended technical support are not included and are only offered under separate agreement with applicable fees.
Scheduling for consultations depends on technician availability and workload.

7. Invoice Validity & Dispute Resolution
The official invoice issued by the company serves as a legally binding sales contract between the two parties, with no need for a separate customer signature.
The invoice includes all transaction details: palm varieties, quantities, prices, payment and delivery terms.
The invoice is governed by the laws of Abu Dhabi Emirate and the UAE Commercial Transactions Law.
In the event of a dispute:
A friendly resolution will be attempted within 15 days of the complaint.
If no agreement is reached, the matter will be referred to:
The Abu Dhabi Commercial Conciliation and Arbitration Center, or
The competent courts within the Emirate of Abu Dhabi.
The official invoice shall serve as a primary legal document and proof of agreement.

8. Governing Laws
All transactions are subject to the laws of the United Arab Emirates.
Contracts shall be interpreted in accordance with the commercial and agricultural regulations in force within Abu Dhabi.
